2. Services Description

Infilstruc provides water delivery services to residential and commercial customers throughout Canada. Our services include:

• Scheduled delivery of bottled water
• Water dispenser rental and maintenance
• Subscription-based delivery plans
• One-time water deliveries

Service availability may vary by location. We reserve the right to modify or discontinue any aspect of our Services at any time.

3. Account Registration and Subscription

3.1 Account Creation

You may need to create an account to access certain features of our Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Subscription Terms

When you subscribe to our water delivery service, you agree to the following:

• You are responsible for providing accurate delivery information
• You will ensure someone is available to receive deliveries or provide safe delivery instructions
• You will return all bottles and equipment at the end of your service period
• You will pay all fees associated with your subscription plan

3.3 Cancellation and Modification

You may cancel or modify your subscription by contacting our customer service at least 48 hours before your next scheduled delivery. Cancellation fees may apply as outlined in your subscription agreement.

4. Payment Terms

4.1 Fees and Charges

You agree to pay all fees associated with your selected service plan. Fees are as described on our website or as communicated to you at the time of purchase.

4.2 Billing

For subscription services, we will bill you on a recurring basis according to your selected billing cycle. You authorize us to charge your payment method for all fees incurred.

4.3 Late Payments

If your payment is not successfully processed, we may suspend or terminate your services. Late payment fees may apply as permitted by law.

5. Delivery and Equipment

5.1 Delivery Schedule

We will deliver water according to your selected delivery schedule. You agree to ensure someone is available to receive deliveries or provide secure delivery instructions.

5.2 Equipment Rental

If you rent water dispensers or other equipment from us:

• You are responsible for maintaining the equipment in good condition
• You will use the equipment only for its intended purpose
• You will return all equipment upon termination of service
• You are responsible for any damage beyond normal wear and tear

5.3 Bottle Deposits and Returns

A refundable deposit may be charged for water bottles. Deposits will be refunded when bottles are returned in good condition.

6. User Conduct

You agree not to:

• Use our Services for any illegal purpose
• Interfere with or disrupt our Services
• Attempt to gain unauthorized access to our systems
• Provide false or misleading information
• Use our Services in a way that could harm us or other users

7. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Infilstruc or our licensors and is protected by Canadian and international copyright and trademark laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

8.1 Disclaimer of Warranties

8.2 Limitation of Liability

To the fullest extent permitted by law, Infilstruc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our Services.

Our total liability for all claims related to the Services shall not exceed the amount paid by you for the Services in the 12 months preceding the event giving rise to the liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless Infilstruc and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or our Services shall be resolved exclusively in the courts of Ontario, Canada.
